Daniel Davis, 44, a former major at Louisiana State Penitentiary (LSP) in Angola, Louisiana, was found guilty by a jury yesterday in federal court for his participation in the beating of an inmate who was handcuffed, shackled, and not resisting and for failing to intervene to stop his subordinates from participating in the same beating. In a previous trial in January 2018, Davis was convicted of conspiring with other officers to cover up the beating by devising a false cover story, submitting false reports documenting that cover story, tampering with witnesses, and lying under oath. Davis was also previously convicted of this beating in November 2018, but was granted a new trial based on juror misconduct.

Four other officers—former LSP Captains James Savoy, John Sanders, and Scotty Kennedy, and former Sergeant Willie Thomas—have all previously pleaded guilty for their roles in the beating and cover up. At Davis’s trial, Captains Sanders and Kennedy testified for the government and described the abuse and the extensive cover up.

 

After hearing testimony over the course of three days, the jury convicted Davis of willfully depriving the inmate of his right to be free from cruel and unusual punishment. The evidence showed that Davis initiated the beating by yanking the inmate’s leg chains, causing the inmate to fall face-first onto the concrete breezeway. At that point, Davis and the other officers punched, kicked, and stomped on the inmate, leaving the inmate with a dislocated shoulder, a hematoma, a collapsed lung, and broken ribs.

The Department of Justice announced that Bahram Karimi was charged with conspiring to commit bank fraud, bank fraud, and making false statements in connection with his involvement in a joint project initiated by the Governments of Iran and Venezuela in which more than $115 million was illegally funneled through the U.S. financial system for the benefit of various Iranian individuals and entities. The case is assigned to U.S. District Judge Alison J. Nathan.

“Karimi allegedly conspired in an infrastructure project initiated by the Governments of Iran and Venezuela,” said Assistant Attorney General for National Security John C. Demers.

“He then lied to banks about Iranian involvement and took advantage of the U.S. financial system to benefit Iranian parties. The Department of Justice will continue to prosecute those who misuse our financial system in violation of U.S. sanctions.”

 

“As alleged, Bahram Karimi knowingly and willfully facilitated the circumventing of sanctions against Iran, and then lied about it to FBI agents,” said U.S. Attorney Geoffrey S. Berman for the Southern District of New York. “Karimi allegedly enabled the concealed transfer through U.S. banks of more than $100 million from a Venezuelan state-owned company to an Iranian construction firm, and when questioned, told the agents he didn’t know that was prohibited by the sanctions.

Patient Services Inc. (PSI), a foundation based in Midlothian, Virginia, agreed to pay $3 million to resolve allegations that it violated the False Claims Act by acting as a conduit to enable certain pharmaceutical companies to provide kickbacks to Medicare patients taking the companies’ drugs by paying the patients’ co-payments, the Department of Justice announced today. The reason for that is when a Medicare beneficiary obtains a prescription drug covered by Medicare Part B or Part D, the beneficiary may be required to make a partial payment, which may take the form of a co-payment, co-insurance, or deductible (collectively, co-pays). Congress included co-pay requirements in these programs, in part, to encourage market forces to serve as a check on health care costs, including the prices that pharmaceutical manufacturers can demand for their drugs. The Anti-Kickback Statute prohibits pharmaceutical companies from offering or paying, directly or indirectly, any remuneration – which includes money or any other thing of value – to induce Medicare patients to purchase the companies’ drugs, and it prohibits third parties, such as copay foundations, from acting as a conduit for such payments.

“The Department is committed to ensuring that foundations are not used as mere conduits to funnel kickbacks from pharmaceutical companies to Medicare patients and to increase company profits while avoiding an important cost-control aspect of the Medicare program,” said Assistant Attorney General Jody Hunt of the Department of Justice’s Civil Division.

“We will continue to combat unlawful kickback arrangements and their pernicious influence on our health care system.”

The first full day of Donald Trump’s Senate impeachment trial was a 13 hours marathon, after which senators finally agreed to the rules that will govern how the rest of the trial plays out, and today, it’s expected we’ll begin to hear the opening arguments, which you can follow in our live blog below.

Schiff is still calling for witnesses and evidence, undeterred by the 11 votes against them yesterday, as he appealed to Republicans to “ensure a fair trial,” by voting to hear from witnesses and see documents he’ll be referring to throughout the trial.
Senate Majority Leader Mitch McConnell kept a provision in the organizing resolution that allows for witness and evidence votes after questioning.

The expected timeline is as follows:

3 days of opening arguments from the Democratic House Managers
3 days of opening arguments from Trump’s defense team (starting on Saturday US time. 
16 hours (most likely two days) of questioning from the Senators, then votes on witnesses and evidence. At this point, there’s nothing to suggest Republicans will change their minds and let that happen.

Chinese authorities have urged people to stop traveling in and out of Wuhan, the city at the center of a new virus outbreak that has killed 17 people, and those living in the city of 8.9 million people have also been told to avoid crowds and minimize public gatherings.

The new virus has spread from Wuhan to several Chinese provinces, as well as the US, Thailand and South Korea, with 440 confirmed cases, with the origin a seafood market that “conducted illegal transactions of wild animals”, as authorities confirmed the number of dead had almost doubled – from nine – in the space of a day. All fatalities so far have been in Hubei, the province around Wuhan.

Officials in Hong Kong also reported the territory’s first two cases.

Meanwhile, in Geneva, the World Health Organization’s emergency committee is meeting to assess the global risks posed by the virus and decide if it should be declared an international public health emergency – as happened with swine flu and Ebola.

President  Trump said he plans to add countries to his existing travel ban to bar more foreign nationals from entry into the US, an expansion of the current ban – signed by him two years ago – closed US borders to citizens from seven countries, most with Muslim majorities, including Libya, Iran, Somalia, Syria, Yemen, North Korea and Venezuela countries from EU, Asia and Africa are also considered.

Mr. Trump confirmed that more countries will be added:

“You see what’s going on in the world, our country has to be safe,” he told reporters at the World Economic Forum in Davos, Switzerland on Wednesday.

In June 2018, the Supreme Court upheld Mr. Trump’s ban, rejecting findings from lower courts that deemed the ban unconstitutional.

Farekh – an American citizen – travelled overseas, joined al Qaeda, and conspired to kill Americans, including through an attack using explosive devices on a U.S. military installation in Afghanistan in 2009,” said Assistant Attorney General Demers. “Across the globe, the National Security Division will continue to relentlessly pursue and bring to justice those who seek to harm Americans, including our brave servicemen and women who risk their lives in defence of our nation. I applaud the efforts of the many agents, analysts, and prosecutors who are responsible for this successful result.”

Before travelling overseas, Farekh and his co-conspirators watched video recordings encouraging violent jihad, listened to jihadist lectures by now-deceased al-Qaeda in the Arabian Peninsula leader Anwar al-Awlaqi, and came to embrace a violent, extremist view of Islam.

Farekh helped to build a vehicle-borne, improvised explosive device (VBIED) that was used in an attack on “Forward Operating Base” Chapman (FOB Chapman), a U.S. military installation that served as the base for the U.S. Provincial Reconstruction Team in Khost, Afghanistan.

The latest news on the squabble between the two “alpha males” bullies on the schoolyard named “Wild” Don and “Bad Haircut” Un is by no means over, despite noises of “hopes” in the “Fake News” media, including a call to award a Nobel Prize to President Trump for finally achieving a peace in Korea.
 
As one of the coldest northern winters in years placed a grip on the divided people of the peninsula, warm moments of hope flickered for few days in the realm of newscasts until the realization that a war is a distinct possibility and some form of military action to disrupt North Korean nuclear weapon developments is inevitable.
More importantly, the globalist media is refusing to recognize the fact that Comrade Un is simply a “glove”, but the “steel hand” inside is that of Mr Xi, the newly crowned “Cult of Personality” shadow of Chairman Mao, whose powers were recently enshrined in China’s Constitution.
Translation? The charade in the Korean Peninsula is nothing else but a rude and brutal, “press the nuke button” poker game initiated by Mr.Xi who perceives US as a weak, bankrupt country whose president is trying to make a turn from the inevitable “abyss” brought by a hostile, “Deep State” parallel government controlled by enemies within, in a desperate attempt to reclaim the strength and glory of the Americas homeland.
