U.S. Department of Justice FY 2019 Contingency Plan – September 11, 2018 –

This FY 2019 Contingency Plan covers the Department of Justice (DOJ or the Department) operations during a lapse in appropriations.

The Antideficiency Act restricts the Federal Government’s ability to obligate funds in advance of appropriations or beyond appropriated levels. During a lapse in appropriations, the Department will only continue the following categories of activities:

1. Those funded by a source that has not lapsed, such as permanent indefinite appropriations and carryover of no-year funds appropriated in a prior year;

2. Those for which there is an express authority to continue during an appropriations lapse;

3. Those for which authority to continue during an appropriations lapse arises by necessary implication;

4. Those related to the discharge of the President’s constitutional duties and powers; and

5. Those related to “emergencies involving the safety of human life or the protection of property,” i.e., where there is a reasonable likelihood that the safety of human life or

the protection of property would be compromised, in some significant degree, by the delay in the performance of the function in question.

The Department of Justice is comprised of about 40 components that have a broad array of national security, law enforcement, and criminal justice system responsibilities. The Department’s mission is to enforce the law and defend the interests of the United States according to the law; to ensure public safety against threats foreign and domestic; to provide federal leadership in preventing and controlling crime; to seek just punishment for those guilty of unlawful behavior; and to ensure fair and impartial administration of justice for all Americans.

Therefore, a significant portion of the Department’s mission relates to the safety of human life and the protection of property, and primarily, for this reason, the Department has a high percentage of activities and employees that are excepted from the Antideficiency Act restrictions and can continue during a lapse in appropriations. Other activities and employees are excepted because they are funded with multi-year or no-year appropriations, or because they are Presidential appointees, most of whom are excepted from furlough because they are not covered by the leave system in 5 U.S.C. Chapter 63.1 Note that the contingency plan assumes that, at the time of a shur=tdown, all Components and Subcomponents normally headed by a Presidential Appointee are in fact headed by a Presidential Appointee.

“The affected areas are settlements and tourist areas along the coast such as Tanjung Lesung Beach, Sumur, Teluk Lada, Penimbang and Carita. The time of many tourists visit the beach along Pandeglang,” a statement about the death toll from the tsunami which hit Indonesia’s Sunda Strait Saturday night has risen to 222, as Sutopo Purwo Nugroho, spokesman of the National Disaster Management Agency said in a statement that the number of injured increased to 843 in the tsunami that was triggered by a volcanic eruption.

Nugroho said that 28 people remain missing, with a total of 556 houses and many buildings damaged after the tsunami — which mostly affected the Pandenglang, South Lampung and Serang areas.

According to the country’s Meteorology, Climatology, and Geophysical Agency, the tsunami could have been triggered by undersea landslides after the eruption of Anak Krakatau.

On Dec. 26, 2004, a magnitude 9.1 earthquake struck the eastern coast of Sumatra, triggering a tsunami that killed around 230,000 people as it tore along the coasts of Sri Lanka, India, Malaysia, Indonesia, and Thailand.

832 people are now confirmed dead in Sulawesi disaster, with many believed trapped in collapsed buildings and outlying areas that have no communications, food, water, fuel, medicine, tents and baby supplies.

Dozens of people were reported to be trapped in the rubble of several hotels and a mall in the city of Palu, on Sulawesi island, which was hit by waves as high as eighteen feet following the magnitude-7.5 earthquake on Friday.

A woman was pulled alive from the debris of the city’s Roa Roa Hotel, where up to 60 people were believed trapped. Hundreds of people gathered at the wrecked eight-story Tatura Mall searching for loved ones.

“Grieve for the people of Central Sulawesi, we all grieve together,” President Joko Widodo tweeted late on Sunday as he inspected the damage.

“When I started to fish we could fill our boat completely in an hour, we couldn’t move, there were fish everywhere,” he says.

“Now there’s less fish, and it’s rare to get a big one.”

The world’s fisheries are in crisis, with the United Nations’ Food and Agriculture Organisation estimates 90% of them have collapsed and China is the dominant player in their demise, having the world’s biggest deep sea fishing fleet that strip mines the world’s oceans.

The fleet has to head deeper into the ocean and stay for longer for a decent catch.

White House adviser Kellyanne Conway has revealed that she was sexually assaulted as a younger woman.

“I’m a victim of sexual assault,” she told CNN without giving details. Ms. Conway, hinting previously that Congressmen molested her. The comment came as she was defending President Trump’s embattled Supreme Court nominee Brett Kavanaugh, who is facing allegations of sexual assault.

“I feel very empathetic… towards victims of sexual assault,” she said.

“I would talk to some of the members of Congress out there,” she said.

“When I was younger and prettier, them rubbing up against girls, sticking their tongues down women’s throats, uninvited, who didn’t like it.”

“I’m a victim of sexual assault. I don’t expect Judge Kavanaugh, or Jake Tapper, or Jeff Flake, or anybody, to be held responsible for that. You have to be responsible for your conduct,” she added. “We do treat people differently who are either the victims or the perpetrators of this based on their politics now, based on their gender. That is a huge mistake.”

During the rally of supporters in West Virginia, President Trump again referred to American media as the “enemy of the people”, and repeated an Indian racial slur against a Senator Elizabeth Warren (D-MA) aka “Pocahontas” about a 17th century Native American who assisted early English settlers in the territory that would later become the state of Virginia. 

The National Congress of American Indians (NCAI), the US indigenous people’s rights organization, has strongly resisted the use of legacy Indian names by Trump.

“We honor the contributions of Pocahontas, a hero to her people, the Pamunkey Indian Tribe in Virginia, who reached across uncertain boundaries and brought people together,” according to an NCAI statement. “Once again, we call upon the president to refrain from using her [Pocahontas] name in a way that denigrates her legacy.”

Trump made the trip to West Virginia to bolster the flagging senatorial campaign of Republican Patrick Morrisey, up against Democrat Joe Manchin in the fiercely-contended November US midterm elections.

ICE officers arrested 40 criminal aliens and immigration violators throughout the New England region during a 3-day enforcement action from Sept. 20-22.

Some of the cities and towns that ERO deportation officers made arrests in during the operation, were: Bridgeport, Bristol, Danbury, Hartford, and Waterbury, Connecticut; in Boston, Brighton, Chelsea, Lowell, Lynn, Malden, Mattapan, Woburn, Revere, and Somerville, and Quincy, Massachusetts; in Brentwood, Manchester, Nashua, and Northwood, New Hampshire; and in East Providence and Providence, Rhode Island.

Foreign nationals from the following countries were arrested during the operation: Mexico, El Salvador, Honduras, Guatemala, the Dominican Republic, Vietnam, Portugal, Ireland, Brazil, Jamaica, Cuba, Ecuador, among others. Most of the aliens targeted by ERO deportation officers during this operation had prior criminal histories that included convictions for crimes such as: assault, burglary, drug trafficking, possession of narcotics, discharge of a firearm, domestic violence, sexual exploitation of minor ,driving under the influence, fraud, illegal entry, hit and run, larceny, weapons possession, and sex offenses, among other charges.

“This operation has removed many dangerous individuals from the community and will help contribute to the safety and security throughout the entire region,” said Todd M. Lyons, acting field office director, ERO Boston. “Part of the ICE/ERO mission is to make our communities safer places to live in by removing criminals; operations like this do exactly that. I applaud the hard work and sheer determination of the dedicated professionals of ICE ERO Boston who make these vital operations possible.”

Eight of those arrested in this operation illegally re-entered the United States after having been previously deported, which is a felony. Depending on an alien’s criminality, an alien who re-enters the United States after having been previously deported commits a crime punishable by up to 20 years in federal prison, if convicted. Four of those arrested have been presented for federal prosecution for re-entry after deportation so far.

A man with a conviction for attempted murder and a woman who has seven convictions for driving under the influence are among the 150 criminal aliens and immigration violators arrested by ICE officers this week. Approximately 40 percent of those aliens apprehended had previously been released by local law enforcement agencies despite ICE placing a detainer, which asks an arresting agency to notify immigration officers before an alien’s release from custody. Of those arrested in Los Angeles and surrounding areas from Sunday through Tuesday, approximately 90 percent had criminal convictions.

“The state laws preventing ICE from working in the jails is significantly impacting public safety by letting serious repeat offenders back out onto our streets,” said Thomas Giles, Acting Field Office Director for ICE Enforcement and Removal Operations (ERO) Los Angeles.

“Our presence would be focused in the jails, rather than in the streets, and safer for all involved, if ICE could again coordinate transfers of criminal aliens with local jails.”

The operation targeted public safety threats, such as convicted criminal aliens and individuals who have violated the immigration laws of the United States – including those who re-entered the country after being deported and immigration fugitives ordered deported by federal immigration judges. Among those arrested during the operation are: A 36-year old citizen of Mexico apprehended in Huntington Beach, Calif. on Sept. 24, who had been arrested and released by local law enforcement agencies three times this year despite ICE having a detainer lodged. His convictions include attempted murder, assault with a deadly weapon, contributing to the delinquency of a minor, failure to register as a sex offender, driving under the influence and possession of a controlled substance.

A tsunami waves of up to six feet tall has hit a small city on the Indonesian island of Sulawesi, collapsing buildings and washing a vessel onto land, after a magnitude-7.5 quake struck offshore, but there has been no word on casualties so far.

Authorities received information that Palu had been hit amid a rapid series of aftershocks,

“The 3 to 6 feet tsunami has receded, it ended,” according to a government official. 

“The situation is chaotic; people are running on the streets and buildings collapsed. There is a ship washed ashore,” she added. Videos circulating on social media show a powerful wave hitting the provincial capital, Palu, with people screaming and running in fear.

At a news conference with the president of Chile, President Trump says he’s going to “let the Senate handle” Kavanaugh.

“They’ll make their decision, and they’ve been doing a good job,” he says. When asked about Ford, Trump says he thought her testimony “was very compelling.”

“I thought that Brett’s testimony, likewise, was something that I haven’t seen before, it was incredible, it was an incredible moment I think in the history of our country.”

He reminds reporters that he isn’t up to speed with all the details given his meeting with Chile’s president, but that he wants “it to work out well for the country.”

As for Senators Lisa Murkowski and Susan Collins, two possible Republican swing votes? Trump has no message for them. “They have to do what they think is right,” he says. The president ended the Kavanaugh questions by saying he’s going to rely on what the senators want to do. “I’ll be reliant on what Senator Grassley and the group decide to do.”
