“Bribery and corruption undermine fair competition and the rule of law. The fact that Joo Hyun Bahn’s intended scheme was thwarted by the greed and deception of one of his co-defendants does not change the fact that he sought to steer an $800 million real estate deal by paying hundreds of thousands of dollars in bribes. The Department is committed to prosecuting those like Bahn who seek to corruptly tilt the playing field to their advantage,” said Acting Assistant Attorney General Cronan as New Jersey real estate broker Joo Hyun Bahn, aka Dennis Bahn, 39, of Tenafly, New Jersey pleaded guilty to his role in foreign bribery scheme involving $800 million international real estate deal to one count of conspiracy to violate the Foreign Corrupt Practices Act (FCPA) and one count of violating the FCPA. 


Bahn was charged alongside his father, Ban Ki Sang (Ban), and Malcolm Harris in December 2016. Ban was a senior executive at Keangnam. Harris, an arts and fashion consultant and blogger, held himself out as an agent of a foreign official.

“As he has now admitted, Joo Hyun Bahn schemed to bribe a foreign official to close an $800 million real estate deal for a skyscraper in Vietnam — a deal that would have earned him a multimillion-dollar commission and much needed capital for his client, Keangnam Enterprises,” said Manhattan U.S. Attorney Berman. “As Bahn’s conviction demonstrates, federal law enforcement stands ready to root out commercial bribery wherever it is found.”

Michael Gluk, 59, the former chief financial officer of ArthroCare Corporation, a publicly traded medical device company based in Austin, Texas, was sentenced today to 50 months in prison for his role in orchestrating a fraud scheme that resulted in shareholder losses of over $750 million.
Gluk admitted that he and his co-conspirators determined the type and amount of product to be shipped to distributors based on ArthroCare’s need to meet Wall Street analyst forecasts, rather than distributors’ actual orders. Gluk and others then caused ArthroCare to “park” millions of dollars’ worth of ArthroCare’s medical devices at its distributors at the end of each relevant quarter. ArthroCare reported these shipments as sales in its quarterly and annual filings at the time of the shipment, enabling the company to meet or exceed internal and external earnings forecasts.

President Trump sent senators a lengthy set of demands that calls for a border wall, more immigration enforcement agents, punishment for so-called “sanctuary cities,” restrictions on citizens and legal residents sponsoring family members’ visas, and policies that make it easier to detain and deport undocumented immigrants. In addition, he is seeking nearly $18 billion to pay for a border wall, a demand that is almost certainly going to sink hopes for deal on the so called DACA aka Dreamers ― young undocumented immigrants who came to the U.S. as children ― and might risk a government funding agreement in the process.

The outrage of the Democrats and immigrant rights activists was immediate and irreversible: The “Trump demands list” could be enough to trigger a opposition party revolt on a government funding bill that needs to pass later this month, Senate Minority Whip Dick Durbin (D-Ill.), whose office shared the White House’s list with reporters, said in a statement.

Economist Ben Stein said the state of California is flirting with “civil war” against the rest of the United States over its refusal to enforce federal immigration policies, a reaction to comments by acting ICE Director Thomas Homan made on “Your World” earlier in the week, in which Homan said citizens will die and Gov. Jerry Brown (D-Calif.) is likely violating federal law by enacting a “sanctuary state” policy. 


“I think that this is essentially a rebellion by the state of California,” Stein said. He said California’s posture looks “very much like the beginning of a civil war,” invoking the actions of April 12, 1861 when the Confederate military fired upon the Union installment at Fort Sumter.”
