Federal authorities this morning arrested eight people named in a federal grand jury indictment that alleges check-kiting schemes that used hundreds of altered Armenian passports to fraudulently open bank accounts and steal nearly $1.5 million from Bank of America and Wells Fargo. A ninth defendant in this case is currently being sought by authorities.

The 36-count indictment unsealed today alleges that the defendants used the bank accounts, which were opened in the names that appeared on the altered passports, to write bad checks to other fraudulently obtained bank accounts, exploiting bank rules to transfer money from one account to another, and then to immediately withdraw funds at ATMs in Las Vegas casinos and other locations before the checks bounced.

ICE found that the defendants obtained genuine Armenian passports issued to other people, altered the passports to include the photos of the defendants, and used the fraudulent documents to obtain other identity documents and to open bank accounts at the victim banks.

The indictment charges all of the defendants with conspiracy to commit bank fraud, a charge that carries a statutory maximum penalty of 30 years in federal prison.

Foreign national identified as Francisco Cuxum Alvarado, a/k/a Francisco Cuxun-Alvarado, 64, wanted in Guatemala for participating in mass sexual assault of indigenous women charged for his role in the 1980s massacre of indigenous Guatemalans, and with illegal re-entry into the United States in federal court in Boston on May 29 after being apprehended by ICE.

“Mr. Cuxum Alvarado is in Massachusetts illegally, evading accountability for human rights violations in Guatemala, said United States Attorney Andrew E Lelling while announcing the details of the case in Boston.

While many immigrants come to this country seeking a better life, Mr. Cuxum Alvarado came here illegally, to escape a dark, criminal past. This case highlights the important work of ICE’s Homeland Security Investigations in identifying and removing war criminals, human rights violators, and other dangerous aliens who illegally seek a safe haven in the United States.

It is alleged that Cuxum Alvarado was a member of the PAC in Rabinal, and in 1998, was named as a suspect in the March 13, 1982, massacre of women and children at Cerro Pacoxom. In 2018, the Guatemalan government charged Cuxum Alvarado with crimes against humanity for participating in the mass sexual assault of Maya Achi women in and around Rabinal. In connection with the charges, the Guatemalan government obtained an INTERPOL Red Notice for Cuxum Alvarado’s arrest, which is a request to law enforcement agencies worldwide to locate and provisionally arrest suspects pending extradition to the jurisdiction in which they are charged. Cuxum Alvarado will be subject to extradition to Guatemala.

A federal grand jury in Las Vegas, Nevada, returned a three-count indictment today against three alleged gang members of La Mara Salvatrucha (MS-13) for their involvement in connection with a kidnapping and murder.

Jose Luis Reynaldo Reyes-Castillo, aka Molesto, 25, Miguel Torres-Escobar, aka Chamilo, 21, and David Arturo Perez-Manchame, aka Walter Melendez and Herbi, 20, are charged with murder in aid of racketeering, using and carrying a firearm during and in relation to a crime of violence and causing death through the use of a firearm.  Reyes-Castillo and Torres-Escobar are citizens of El Salvador and Perez-Manchame is a citizen of Honduras.  All of the defendants are illegally in the United States.

According to the indictment, MS-13 is a violent, transnational criminal organization that operates throughout the United States, including in Las Vegas, Nevada.  MS-13 is a street gang composed primarily of persons from Central America, including El Salvador, Honduras and Guatemala.  The Parkview clique of MS-13 operated in the Las Vegas, Nevada sector.  MS-13 members are required to commit crimes, including acts of violence, to maintain membership and discipline within the group.

The indictment alleges that, on Jan. 21, 2018, Reyes-Castillo, Torres-Escobar and Perez-Manchame, kidnapped and murdered Arquimidez Sandoval-Martinez.  As alleged, the defendants intentionally participated in the act of violence that resulted in the death of Sandoval-Martinez.

A former Central Intelligence Agency (CIA) case officer pleaded guilty today to conspiring to communicate, deliver and transmit national defense information to the People’s Republic of China.  

Jerry Chun Shing Lee, 54, left the CIA in 2007 and began residing in Hong Kong.  In April 2010, two Chinese intelligence officers (IOs) approached Lee and offered to pay him for national defense information he had acquired as a CIA case officer.  The IOs also told Lee they had prepared for him a gift of $100,000 cash, and they offered to take care of him “for life” in exchange for his cooperation.

Beginning sometime in May 2010 and continuing into at least 2011, Lee received requests for information, or taskings, from the Chinese IOs.  The majority of the taskings asked Lee to reveal sensitive information about the CIA, including national defense information.  On May 14, 2010, Lee made or caused to be made a cash deposit of $138,000 HKD (approximately $17,468 in USD) into his personal bank account in Hong Kong.  This would be the first of hundreds of thousands of dollars (USD equivalent) in cash deposits Lee made or caused to be made into his personal HSBC account from May 2010 through December 2013.

“This is the third case in less than a year in which a former US intelligence officer has pled or been found guilty of conspiring with Chinese intelligence services to pass them national defense information,” said Assistant Attorney General Demers.
