A Los Angeles, California-based dentist was sentenced to 40 months in prison today for his role in a $3.8 million health care fraud scheme in which he billed numerous dental insurance carriers for crowns and fillings that were never provided to patients.

Benjamin Rosenberg, D.D.S., 59, of Los Angeles, was sentenced by U.S. District Judge John A. Kronstadt of the Central District of California, who also ordered Rosenberg to pay $1,414,011.59 in restitution. He pleaded guilty on Jan. 31, 2019, to one count of health care fraud.

As part of his guilty plea, Rosenberg admitted that he submitted and caused to be submitted approximately $3,853,931 in false and fraudulent claims to various insurance companies for dental care that he knew had not been rendered. Rosenberg further admitted that he submitted these false and fraudulent claims to Denti- Cal (California Medi-Cal Dental Program), Metlife, Anthem, Cigna, Delta Dental, Guardian, LMCO-DHA, United Healthcare and United Concordia (the carriers), which caused the carriers to pay Rosenberg approximately $1,415,011.

This case was investigated by the FBI. Trial Attorney Emily Z. Culbertson of the Criminal Division’s Fraud Section is prosecuting the case.

Three residents of Lima, Peru, pleaded guilty yesterday to extortion for overseeing a ring of call centers that threatened and extorted Spanish-speaking victims in the United States, the Department of Justice and U.S. Postal Inspection Service announced.

Jesus Gerardo Gutierrez Rojas, 37, Maria de Guadalupe Alexandra Podesta Bengoa, 38, and Virgilio Ignacio Polo Davila, 43, were extradited from Peru in April and pleaded guilty before U.S. District Court Judge Roy K. Altman in Fort Lauderdale yesterday. As part of his guilty plea, Gutierrez admitted that he oversaw a number of affiliated call centers in Peru that falsely told Spanish-speaking victims across the United States that they had incurred debts and would suffer various consequences for failure to pay off the debts that they did not, in fact, owe. As part of their guilty pleas, Podesta and Polo admitted that they managed and supervised two of these affiliated call centers that used extortion to obtain money from U.S. victims.

“The Department of Justice is committed to identifying and prosecuting criminals who target and extort U.S. consumers,” said Assistant Attorney General Jody Hunt.

“Yesterday’s guilty pleas demonstrate that those who threaten U.S. consumers by phone cannot escape justice by placing their calls from abroad. Working with our international partners, we will bring them to justice no matter where they reside. I thank the Republic of Peru for extraditing these defendants to face justice in our courts and the U.S. Postal Insecption Service for its work investigating this case.”

The scientists assume that Bolshaya Udina may repeat the fate of the neighbouring volcano Bezimyanny (Unnamed), which was not viewed upon as a separate active volcano, but unexpectedly suffered a massive blast in 1956.

“When a volcano is silent for a lengthy period of time, its first explosion may yield horrific consequences. Vast amounts of ash are spewed into the air, spreading over large swathes of land all over the planet,” said academician Ivan Kulakov the head of the seismic tomography laboratory at the Novosibirsk-based Trophimuk Institute of oil and gas geology and geophysics.

Homeland Security Investigations (HSI) Yuma special agents arrested Angel Leon-Camberos, 26, and seized 527.3 lbs. of methamphetamine (approximate street value of nearly $7.2 million), 14.88 lbs. of high grade marijuana and numerous wax (marijuana extract) products with an approximate street value of $103,930, one AR-15 style rifle, one magazine, packaging materials, multiple cell phones and $15,295 in cash in a targeted enforcement action lead by HSI.

Based on the quantity of seized contraband and the arrest, HSI special agents were contacted to continue the investigation. Based on the findings during the traffic stop and the subsequent investigation conducted by HSI special agents, a state search warrant was secured and executed at Leon-Camberos’ residence near Amarely Avenue that resulted in the additional seizure of 432.22 lbs. of methamphetamine, one AR-15 style rifle and one magazine, 14.88 lbs. of marijuana to include THC vape pens and approximately $15,295 in cash.

The defendant was presented and charged with multiple Arizona state drug charges including importation/transportation of dangerous drugs, misconduct involving weapons, and possession of narcotics for sale.

U.S. District Court Judge Laurie Smith Camp sentenced Sebastian Velasquez-Ramos, 47, to 28 months in federal prison following his criminal convictions for fraudulently using a Social Security card, falsely claiming U.S. citizenship, and aggravated identity theft. Velasquez-Ramos previously pleaded guilty to the charges.

An investigation determined that in 2017, Velasquez-Ramos used a false social security number, and he falsely claimed that he was a U.S. citizen to obtain employment at an Omaha company.

Velasquez-Ramos is also currently serving a separate prison sentence following a state conviction for leaving the scene of a fatal multi-vehicle crash. In April 2018, Velasquez-Ramos fatally hit a motorcyclist in Omaha and left the scene of the crash.

The 28-month federal sentence is to be served consecutively to the state sentence Velasquez-Ramos is now serving. In addition to his federal prison sentence, he must also complete three years of supervised release. There is no parole in the federal prison system.

Opioid manufacturer Insys Therapeutics agreed to a global resolution to settle the government’s separate criminal and civil investigations, the Department of Justice announced today.

As part of the criminal resolution, Insys will enter into a deferred prosecution agreement with the government, Insys’s operating subsidiary will plead guilty to five counts of mail fraud, and the company will pay a $2 million fine and $28 million in forfeiture.

As part of the civil resolution, Insys agreed to pay $195 million to settle allegations that it violated the False Claims Act. Both the criminal and civil investigations stemmed from Insys’s payment of kickbacks and other unlawful marketing practices in connection with the marketing of Subsys.

Insys’s drug Subsys is a sublingual fentanyl spray, a powerful, but highly addictive, opioid painkiller. In 2012, Subsys was approved by the Food and Drug Administration for the treatment of persistent breakthrough pain in adult cancer patients who are already receiving, and tolerant to, around-the-clock opioid therapy.

Joseph P. Galichia M.D., a Wichita, Kansas, cardiologist, has agreed to pay $5.8 million to resolve allegations that he and his medical group, Galichia Medical Group, P.A. (GMED), violated the False Claims Act by improperly billing federal health care programs for medically unnecessary cardiac stent procedures, the Department of Justice announced. Galichia also agreed to a three-year period of exclusion from participation in any federal health care program. The settlement relates to a lawsuit in which the United States intervened on Dec. 12, 2014.

“This settlement reflects the Department of Justice’s commitment to ensuring the safety of federal health care program beneficiaries and that taxpayer monies are properly spent,” said Assistant Attorney General Jody Hunt of the Department of Justice’s Civil Division.

“Patient safety is critically important,” said U.S. Attorney Stephen McAllister for the District of Kansas. “Performing medically unnecessary procedures puts patients at risk and defrauds federal health care programs.”

“When a physician bills the government for medically unnecessary procedures, both patients’ health and taxpayers can end up paying the price,” said Special Agent in Charge Steve Hanson of the Office of Inspector General for the U.S. Department of Health and Human Services.

“OIG is excluding Dr. Galichia from participation in Medicare, Medicaid, and other federal health care programs, and we will continue to work with our partners to protect the health and welfare of Medicare beneficiaries.”

Khristal Ford, 32, a former Lieutenant at the Federal Correctional Complex (FCC) in Beaumont, Texas, pleaded guilty today to aiding and abetting another correctional officer in his assault on an inmate.

According to the plea documents and information presented in court, Khristal Ford was a supervisory correctional officer at the FCC on June 8, 2017, when Ford opened the door of a medical observation cell where A.A., an inmate, was being held. Ford then told a senior correctional officer to “take care of it” and watched as the officer entered the cell and punched A.A. in the head three times without justification. Following this assault, Ford submitted a written memorandum that omitted any reference to the punches and included a falsified breathalyzer photo sheet, all in an effort to conceal the incident and make it appear as if the victim was highly intoxicated at the time of the officer’s assault.

“This type of behavior in our correctional officers erodes public trust,” said Assistant Attorney General Eric Dreiband of the Civil Rights Division.

“The Department of Justice will vigorously prosecute those who violate the civil rights of inmates.”

“When correctional officers abuse their authority like this, it hurts more than the victim of the assault,” said U.S. Attorney Joseph Brown of the Eastern District of Texas.

“It damages the whole system, hurting the credibility of the good officers who try to do the right thing every day. We will do everything we can to make sure these kinds of violations are prosecuted.”

Ford will be sentenced at a later date and faces a maximum statutory penalty of 10 years in prison and a fine of up to $250,000.

Following Mr. Mueller’s comments , his first public statement on his inquiry – Democratic presidential candidates called for the Republican president to be impeached, but the Democratic leadership of the House of Representatives is skeptical of such a move, since any attempt to remove the president from office would almost certainly be rejected by the Republican-controlled Senate.

According to Mellon, they have plausible clues that the controversial objects reported by Navy pilots in 2014 and 2015 were doing something that isn’t at all possible in this physical realm.
