2…………> Illegals Attack CBP Officer: Forcible Assault


Two men from Irving, Texas, identified as Juan Alfredo Crisencio Martinez, 20, and Jaythan Trevonne Phillips, 20, were charged for their role in forcibly assaulting a federal officer on February 20 at  the Juarez-Lincoln International Bridge in Laredo, when  a CBP officer began to conduct an immigration inspection and asked them to exit the vehicle, but  they refused.

The charges allege authorities swarmed the lane to apprehend the occupants,  at that time, Martinez allegedly reached for the officer’s belt from inside the vehicle. He also opened the driver’s side door in order to prevent a responding officer from assisting, according to the allegations, and law enforcement allegedly had to physically carry Phillips to the secondary inspection area.

Martinez continued to resist, according to the allegations. Law enforcement allegedly had to deploy a Taser in order to subdue him.

The charges allege the incident significantly impacted the port’s daily operation, because officers from passenger booths, secondary inspection and bus operations had to assist. Most of the travel lanes were closed until they could resolve the incident, according to the allegations. The bus traffic was allegedly backed up into the Mexico side of the bridge which caused stalls and ultimately delayed dozens of passengers.

A federal jury sitting in Charlotte, North Carolina, has convicted the founder and chairman of a multinational investment company and a company consultant of public corruption and bribery charges, for orchestrating a bribery scheme involving independent expenditure accounts and improper campaign contributions.

Greg E. Lindberg, 49, of Durham, North Carolina, the founder and chairman of Eli Global LLC (Eli Global) and the owner of Global Bankers Insurance Group (GBIG), and Lindberg’s consultant, John D. Gray, 69, of Chapel Hill, North Carolina, were convicted of conspiracy to commit honest services wire fraud and bribery concerning programs receiving federal funds after an approximately three-week trial before U.S. District Judge Max O. Cogburn Jr.  A third co-defendant, Eli Global executive John V. Palermo, 64, of Pittsboro, North Carolina, was acquitted by the jury.  A fourth co-defendant, Robert Cannon Hayes, 74, of Concord, North Carolina, previously pleaded guilty to making false statements to the FBI.

“Greg Lindberg and John Gray undermined public confidence in our government by promising millions of dollars in campaign contributions in exchange for government decisions to benefit Lindberg’s business interests,” said Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division.  “The department is grateful for the assistance of the law-abiding public officials who reported the attempted bribes in this case, which allowed us to use all the tools at our disposal to investigate and root out this pernicious and greedy effort to corrupt North Carolina state government.”

“The defendants devised an elaborate plan to make a hefty campaign contribution to an elected official to secure favorable action.  This was not a lapse in judgment.  It was a deliberate bribery attempt and a clear violation of federal law,” said U.S. Attorney Andrew Murray for the Western District of North Carolina.  “Public corruption is a threat to our way of life and if left unchecked it can tear apart the very fabric of our country. My office will continue to diligently ferret out public corruption schemes to protect the public and hold bad actors like these unscrupulous defendants accountable.”

“Greg Lindberg and John Gray plowed across the line from legal political donations to felonious bribery,” said Special Agent in Charge John Strong of the FBI’s Charlotte Field Office.  “These men thought they could buy changes to North Carolina Department of Insurance personnel, policies, and procedures to benefit Lindberg’s businesses.  The FBI will work tirelessly to root out any and all forms of public corruption.”

A federal grand jury indicted a state-owned enterprise of the People’s Republic of China (PRC), a Taiwan company, and three individuals, charging them with crimes related to a conspiracy to steal, convey, and possess stolen trade secrets of an American semiconductor company for the benefit of a company controlled by the PRC government. All of the defendants are charged with a conspiracy to commit economic espionage, among other crimes. Also, the United States filed a civil lawsuit seeking to enjoin the further transfer of the stolen trade secrets and to enjoin certain defendants from exporting to the United States any products manufactured by UMC or Jinhua that were created using the trade secrets at issue.

“I am announcing that a grand jury in San Francisco has returned a multi-defendant indictment alleging economic espionage on the part of a state-owned Chinese company, a Taiwanese company, and three Taiwan individuals for an alleged scheme to steal trade secrets from Micron, an Idaho-based semiconductor company,” said Attorney General Sessions.

“Micron is worth an estimated $100 billion and has a 20 to 25 percent share of the dynamic random access memory industry—a technology not possessed by the Chinese until very recently. As this and other recent cases have shown, Chinese economic espionage against the United States has been increasing—and it has been increasing rapidly. I am here to say that enough is enough. With integrity and professionalism, the Department of Justice will aggressively prosecute such illegal activity.”

According to the indictment, the defendants were engaged in a conspiracy to steal the trade secrets of Micron Technology, Inc. (Micron), a leader in the global semiconductor industry specializing in the advanced research, development, and manufacturing of memory products, including dynamic random-access memory (DRAM).

The Federal Circuit Court of Appeals issued a precedential opinion today affirming the Court of Federal Claims decision that federal corporate taxpayers may not deduct as a cost of goods sold expense an excise tax expense that was never actually incurred or paid. In Sunoco, Inc. v. United States, No. 2017-1402, the Federal Circuit Court of Appeals affirmed the decision of the Court of Federal Claims and the position of the United States. Sunoco, Inc., a petroleum and petrochemical company, claimed approximately $1 billion in alcohol fuel mixture credits on its federal excise tax returns thereby reducing its federal fuel excise tax liability by the same amount. By including the $1 billion in excise tax expenses in its cost of goods sold, Sunoco, Inc. sought to reduce its federal corporate income taxes with an excise tax expense that was never paid. The Federal Circuit held that the plain language of the Internal Revenue Code precluded Sunoco, Inc.’s attempt to obtain a 300 million dollars “windfall” reduction in tax. The court also stated, “We have already established that Congress does not generally allow taxpayers to receive a tax benefit twice.”

In the last few days, Mr. Trump has made a high profile push for making schools “hard targets” for gunmen, including supporting the arming of teachers after America’s worst ever high school shooting when 17 people died in Florida last week.

ICE officers arrested 145 criminal aliens and immigration violators in South and Central Texas during a seven-day enforcement action, out of which 86 had criminal convictions; 39 were arrested based on previous immigration encounters, four of which have pending criminal charges; 20 had no prior immigration history or encounters, one has pending criminal charges. Of the total arrests, 135 were men and 10 were women, with ages ranging from 18 to 62 years old.

Criminal aliens arrested during this operation came from the following countries: Mexico (128), Guatemala (7), El Salvador (1), Honduras (7), Peru (1) and Jordan (1), and were accused in variety of crimes including indecency with a child, assault, deadly conduct, aggravated assault with a deadly weapon, drug possession, drug trafficking, burglary, resisting arrest, firearms offense, alien smuggling, illegally entering the U.S., and driving under the influence (DUI).

William Curtis Howell, 61, a former supervisory deputy jailer at the Kentucky River Regional Jail (KRRJ) in Perry County, Kentucky, was sentenced to 120 months in federal prison related to his role in violently assaulting a pre-trial detainee Larry Trent, 54, and to deliberately denying him medical care after violently beating him, a criminal action that led to his death due to internal bleeding caused by a displaced pelvic fracture, and blunt force trauma to his head, torso, and extremities.

On July 9, 2013, at the Kentucky River Regional Jail in Hazard, Kentucky, Hickman and his deputy Howell violently beat Trent and left him in his cell, seriously injured and bleeding from an open head wound. Trent, who was in custody for a DUI charge, ultimately died from injuries sustained during the beating. Hickman, who was initially charged along with Howell, pleaded guilty prior to trial and testified against Howell.
