Very sad to hear the news on the passing of my friend, Senator Thad Cochran. He was a real Senator with incredible values – even flew back to Senate from Mississippi for important Healthcare Vote when he was desperately ill. Thad never let our Country (or me) down!

Robert Mueller came to the Oval Office (along with other potential candidates) seeking to be named the Director of the FBI. He had already been in that position for 12 years, I told him NO. The next day he was named Special Counsel – A total Conflict of Interest. NICE!

2…………>  Cardiology Scam: Kansas

Joseph P. Galichia M.D., a Wichita, Kansas, cardiologist, has agreed to pay $5.8 million to resolve allegations that he and his medical group, Galichia Medical Group, P.A. (GMED), violated the False Claims Act by improperly billing federal health care programs for medically unnecessary cardiac stent procedures, the Department of Justice announced. Galichia also agreed to a three-year period of exclusion from participation in any federal health care program. The settlement relates to a lawsuit in which the United States intervened on Dec. 12, 2014.

“This settlement reflects the Department of Justice’s commitment to ensuring the safety of federal health care program beneficiaries and that taxpayer monies are properly spent,” said Assistant Attorney General Jody Hunt of the Department of Justice’s Civil Division.

“Patient safety is critically important,” said U.S. Attorney Stephen McAllister for the District of Kansas. “Performing medically unnecessary procedures puts patients at risk and defrauds federal health care programs.”

“When a physician bills the government for medically unnecessary procedures, both patients’ health and taxpayers can end up paying the price,” said Special Agent in Charge Steve Hanson of the Office of Inspector General for the U.S. Department of Health and Human Services.

“OIG is excluding Dr. Galichia from participation in Medicare, Medicaid, and other federal health care programs, and we will continue to work with our partners to protect the health and welfare of Medicare beneficiaries.”

3…………> Prison Guard Brutality: Beaumont, Texas

Khristal Ford, 32, a former Lieutenant at the Federal Correctional Complex (FCC) in Beaumont, Texas, pleaded guilty today to aiding and abetting another correctional officer in his assault on an inmate.

According to the plea documents and information presented in court, Khristal Ford was a supervisory correctional officer at the FCC on June 8, 2017, when Ford opened the door of a medical observation cell where A.A., an inmate, was being held. Ford then told a senior correctional officer to “take care of it” and watched as the officer entered the cell and punched A.A. in the head three times without justification. Following this assault, Ford submitted a written memorandum that omitted any reference to the punches and included a falsified breathalyzer photo sheet, all in an effort to conceal the incident and make it appear as if the victim was highly intoxicated at the time of the officer’s assault.

“This type of behavior in our correctional officers erodes public trust,” said Assistant Attorney General Eric Dreiband of the Civil Rights Division.

“The Department of Justice will vigorously prosecute those who violate the civil rights of inmates.”

“When correctional officers abuse their authority like this, it hurts more than the victim of the assault,” said U.S. Attorney Joseph Brown of the Eastern District of Texas.

“It damages the whole system, hurting the credibility of the good officers who try to do the right thing every day. We will do everything we can to make sure these kinds of violations are prosecuted.”

Ford will be sentenced at a later date and faces a maximum statutory penalty of 10 years in prison and a fine of up to $250,000.

The Greatest Presidential Harassment in history. After spending $40,000,000 over two dark years, with unlimited access, people, resources and cooperation, highly conflicted Robert Mueller would have brought charges, if he had ANYTHING, but there were no charges to bring!

As he prepared to board a helicopter to Colorado to address military graduates, Mr Trump said: “Robert Mueller should never have been chosen because he wanted the FBI job and he didn’t get it and the next day he was picked as special counsel. After spending $40,000,000 over two dark years, with unlimited access, people, resources and cooperation, highly conflicted Robert Mueller would have brought charges, if he had ANYTHING, but there were no charges to bring!”.

Following Mr. Mueller’s comments , his first public statement on his inquiry – Democratic presidential candidates called for the Republican president to be impeached, but the Democratic leadership of the House of Representatives is skeptical of such a move, since any attempt to remove the president from office would almost certainly be rejected by the Republican-controlled Senate.

5…………> We Know UFO Are Here: US Military Intel Boss

The Pentagon has avoided using the term “UFOs” in its statements and reviews for decades, despite multiple reports from military and civilian pilots about unknown aircraft sightings, and regular encounters with unidentified flying objects in 2014 and 2015, but now Christopher Melon, former deputy assistant secretary of defense for intelligence, pointed out the reasons the Navy is taking a special interest in pilot testimonies, saying that the DOD is well aware of the fact that UFOs exist, but adding that this is no longer an issue.

“The issue is why are they here? Where are they coming from and what is the technology behind these devices that we are observing?” he proposed a question.

According to Mellon, they have plausible clues that the controversial objects reported by Navy pilots in 2014 and 2015 were doing something that isn’t at all possible in this physical realm.

As an example, he cited the speed of an object being reported as climbing to 5,000 miles per hour, which could be sustainable for only about an hour by an aircraft in the air, whereas those witnessed would be flying all day long, according to the “mystified” pilots. (Sputnik)

2…………> Dark Net Fentanyl Dealer: Busted

A federal grand jury charged Sean Shaughnessy, 51, with conspiracy to possess with intent to distribute controlled substances, distribution of a controlled substance, distribution of a controlled substance analogue, and eight counts of money laundering.

According to the indictment, which was unsealed May 24 following the defendant’s initial appearance, Shaughnessy allegedly sold fentanyl and fentanyl analogues over the dark web, an unindexed portion of the internet accessible only via specialized software that allows users to conduct transactions with relative anonymity.

Our significant domestic and international HSI resources and expertise, along with the considerable resources of our law enforcement partners, provided an unbeatable team to investigate this fentanyl smuggling operation so that we could effect this indictment, said Katherine Greer, Acting Special Agent in Charge of HSI Dallas.

Fentanyl and its analogues – among the most lethal opioids used in the United States, according to the Drug Enforcement Administration – are partly responsible for the sharp increase in opioid deaths across the nation

This case was investigated by US Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI), IRS’s Criminal Investigation Division’s Los Angeles field office, and US Postal Inspection Service.

4…………> Robert Mueller Final Report: Resignation

Two years ago, the Acting Attorney General asked me to serve as Special Counsel, and he created the Special Counsel’s Office.

The appointment order directed the office to investigate Russian interference in the 2016 presidential election.  This included investigating any links or coordination between the Russian government and individuals associated with the Trump campaign.

I have not spoken publicly during our investigation.  I am speaking today because our investigation is complete. The Attorney General has made the report on our investigation largely public.  And we are formally closing the Special Counsel’s Office.  As well, I am resigning from the Department of Justice and returning to private life.

I’ll make a few remarks about the results of our work.  But beyond these few remarks, it is important that the office’s written work speak for itself.

Let me begin where the appointment order begins: and that is interference in the 2016 presidential election.

As alleged by the grand jury in an indictment, Russian intelligence officers who were part of the Russian military launched a concerted attack on our political system.

The indictment alleges that they used sophisticated cyber techniques to hack into computers and networks used by the Clinton campaign.  They stole private information, and then released that information through fake online identities and through the organization WikiLeaks.  The releases were designed and timed to interfere with our election and to damage a presidential candidate.

And at the same time, as the grand jury alleged in a separate indictment, a private Russian entity engaged in a social media operation where Russian citizens posed as Americans in order to interfere in the election.

These indictments contain allegations.  And we are not commenting on the guilt or innocence of any specific defendant.  Every defendant is presumed innocent unless and until proven guilty in court.

The indictments allege, and the other activities in our report describe, efforts to interfere in our political system.  They needed to be investigated and understood.  That is among the reasons why the Department of Justice established our office.

That is also a reason we investigated efforts to obstruct the investigation.  The matters we investigated were of paramount importance.  It was critical for us to obtain full and accurate information from every person we questioned.  When a subject of an investigation obstructs that investigation or lies to investigators, it strikes at the core of the government’s effort to find the truth and hold wrongdoers accountable.

Let me say a word about the report.  The report has two parts addressing the two main issues we were asked to investigate.

The first volume of the report details numerous efforts emanating from Russia to influence the election.  This volume includes a discussion of the Trump campaign’s response to this activity, as well as our conclusion that there was insufficient evidence to charge a broader conspiracy.

And in the second volume, the report describes the results and analysis of our obstruction of justice investigation involving the President. (Please read the complete report at the link below)

2…………> “Yalla” Driver Licenses: Sweden

The Transport Administration of the Islamic Sheikdom of Sweden launched an information campaign in Arabic called “Yalla Driver’s License” using the Arabic expression Yalla, led by a star blogger Mahmoud Bitar with over 1.5 million followers on social media and Tahani Abood, a program host at Alkompis which is largest news channel for Arabic speakers, about the process of getting a driver’s license in Sweden, featuring an Muslim immigrant couple complaining about the weather in the Scandinavian country and using a derogatory racial epithet for “Swedes”.

In 2018, Arabic was estimated to have surpassed Finnish as Sweden’s second-largest native language, as speakers of Arabic swelled into the Scandinavian country amid the European migrant crisis.

While some praised Tahanny and Mahmoud for their performance and hailed the Transport Agency’s accommodating approach, others slammed the very idea of running the entire film in Arabic

“In Sweden, Arabic is now the largest language after Swedish and at the Swedish Transport Administration about 20 percent of all knowledge tests are written in Arabic. We want to change this by reaching out to the target group about what is required to be a safe driver”, Kristina Hagberg of the Swedish Transport Administration said.

3…………> Lower Court Anti-Trump Injunctions A Threat To US: AG Barr

Thank you.  I’m honored to address the American Law Institute this evening.  Among this distinguished company, it is not possible to acknowledge all who merit it.  However, I would like to mention a couple of my dinner companions.  I want to thank David Levi, the President of ALI, for inviting me.

David and I were colleagues 30 years ago at the Department of Justice and have remained friends.  When I was recently confirmed again as Attorney General I was delighted to hear that David’s son, Will, had joined the AG’s staff.  The apple does not fall far from the tree.  I am delighted Will agreed to stay on with me, and he is doing an outstanding job.

I also want to salute a man who I believe is a great American jurist, but also, in my opinion, one of the greatest AG’s to ever hold the office – Mike Mukasey.  I have placed his official portrait in my office to remind me of his example.

We are also joined by many prominent judges, practitioners, and law professors.  Thank you for being here and for supporting the thoughtful study and administration of law.

In this town, there’s a tendency to focus on the news of the day, as the past few weeks have reminded me.  But the role of groups like ALI is to remind us of the bigger picture.  So tonight, I want to take several steps back—to our Nation’s Founding.

The central genius of the American Constitution lies in its use of structure to protect individual liberty.  It does not rely solely, or even primarily, on grants of substantive rights.  As Justice Scalia colorfully quipped, “Every banana republic has a bill of rights.”  His point—and mine—is that the bulwark against tyranny in America has always been our structure of government, most notably the Separation of Powers.

These days, clashes between Congress and the Executive steal the headlines.  I know that all too well.  But clashes between the Judiciary and the Political Branches are just as weighty.

While the Framers had concerns about an unelected Judiciary encroaching on the prerogatives of the Political Branches, Hamilton promised in Federalist 78 that the least democratic branch would also be the “least dangerous” branch because courts have “no influence over either the sword or the purse … neither force nor will, but merely judgment.”  Today, that assurance does not instill much confidence.  We have seen over time an expansion of judicial willingness to review executive action.  Then, combine that with the strategies of sophisticated public-interest lawyers and the aggressive practices of some courts, such as the novel and growing use of nationwide injunctions.  The legal community and the broader public should be more concerned, particularly about this trend of nationwide injunctions.

Tonight, I wish to discuss some of the reasons why.  Let me start with perhaps the most remarkable example:  the ongoing litigation over the DACA (or Deferred Action for Childhood Arrivals) program.

You all know the basic backstory.  It starts with the DREAM Act, which would provide legal status to certain aliens who came to the United States as minors.  Congress has never passed it.  But in 2012, the Obama Administration announced the DACA program, under which DHS assumed a non-enforcement posture and extended work authorization to those covered by the proposed DREAM Act.  That policy was controversial.  It used prosecutorial discretion to implement an unenacted statute, and many argued that it exceeded Executive authority.  Several States, led by Texas, obtained a nationwide injunction against extended versions of the policy—which an equally divided Supreme Court affirmed—and they threatened to challenge DACA itself.

But in 2017, the Trump Administration announced that it would wind down DACA.  That decision was also controversial, though no one seriously contends that DACA is required by law.  Two district judges in California and New York have nevertheless issued nationwide injunctions against the rescission—that is, effectively requiring the government to reinstate DACA notwithstanding the President’s contrary exercise of discretion.  Appeals have been ongoing for nearly a year-and-a-half, but the injunctions remain in place.

This saga highlights a number of troubling consequences of the rise of nationwide injunctions:

First, these nationwide injunctions have frustrated presidential policy for most of the President’s term with no clear end in sight.  We are more than halfway through the President’s term, and the Administration has not been able to rescind the signature immigration initiative of the last Administration, even though it rests entirely on executive discretion.  The Justice Department has tried for more than a year to get the Supreme Court to review the lower-court decisions ordering us to keep DACA in place.  But the Court has not granted any of those requests, and they languish on its Conference docket.  Unless the Court acts quickly and decisively, we are unlikely to see a decision before mid-2020 at the earliest—that is, right before the next presidential election.  It is hard to imagine a clearer example of the stakes of nationwide injunctions.
